I marked her as disapproved because of copyright issues.

This morning I noticed that Galipe had uploaded a Posette character named Karine.  Galipe did not post anything about his upload, so I posted a news item about it.

That was before I left home for the day.  Since I returned, I downloaded a copy of Karine and took a look at the contents of the zip, I found that he included textures maps, a Poser weblink file, A CR2 and an OBJ.

The OBJ file is that of P4 Posette, meaning that this package is a copyright violation.  Anyone who never bought Poser 4+ but has DAZ Studio or Poser 3 does not have P4 Posette, but by downloading this archive would have have a working copy of Posette.

Also the CR2 contains a copy of Kozaburo's KyokoHairMK2 that is built on a hair mesh by Yamato, and that package has a modified texture map for that hair.  There are free characters from Japan who are packages with a transmapped hair prop by Kozaburo [i:985e54d36c]With his knowldege and permission[/i:985e54d36c]

In this case, there is nothing in the package to indicate that Kozaburo has granted his permission for the use of that hair this way.  Infact at the beginning of the readme file it says:

Also the weblink leads to a site that seems to be unrelated to the character or to this person.

It may be that this person is new and does not understand the copyright problems in this package.  Or then again...

For the moment the situatin is safe, the file can not be downloaded and the announcement that I posted has been moved to this forum and locked, so that no one except PF staff can see the announcement.  We have time to stop and consider what to do.

The question is what should we do?

I am am thinking that we should delete the character, and the announcement topic, then send Galipe an email explaining why.

One would hope is is a misunderstanding or lack of understanding of the copyright issues.  I think the proper thing to do is delete the character and announcement and an email why it was done.  

I thought for a moment, since the d/l and announcement were locked, to send an email first (benefit of the doubt), but the character will have to be deleted anyway, so be safe, delete now and then ask questions.

I think, melamkish is right, we should be careful with this kind of issue.
( though I´m happy, I came to my Posette4 mesh similar way . Downloaded a free charcter and an obj was incuded, on another page..., and the file is still up   )

The file P4NudeWom.obj should not be included, distributing it is this
way is a copyright violation and is not permitted by the copyright owners.  
Having purchased a copy of Poser you have the right to use that file, but
you do not have the right to give it to other people.  You must remove
this file.

You used Koyko Hair Mk 2, that is alright to do.  However, you included
the hair in the file Karine.cr2.  This you can not do without permission
from Kozaburo and Yamato.  You downloaded this hair for free as in not
having to pay for it.  However, the hair is not a free of copyright, it is
not in the public domain.  The hair was created by Kozaburo and the mesh
that it is based on was created by Yamato, they own the copyright for the
hair, so you need to contact them and get permission to distribute the
hair with your character.  And you must say that in the ReadMe.txt file,
and then that statement will be tested by the staff of Posetteforever by
asking our asking the copyright owners of the hair, if they will confirm
that they gave you that permission.  Failing to get their permission, you
must remove the hair from this package, including the hair's texture map.

There is a weblink file 3dtrue.pzs in Karine's zip archive.  It needs to
be removed.  If it is your website, include that information in the
ReadMe.txt file instead of the 3dtrue.pzs file.

The bumpmap file "karine -bump copie.jpg"  appears to be a jpg version of
the standard Poser 4 Posette bump map.  Remove the bumpmap and edit the
texture setting of Karine to use "P4 woman bump.TIF" instead.  But do not
include "P4 woman bump.TIF"

I have not examined the character further, so I do not know which morphs
your are using to give your character her appearance. Did you use any
morphs?  If you did, and used any morphs that you did not create and were
not a part of the standard Posette.  You must mention the creators of the
morphs in your ReadMe.txt file.  You most also have permission from those
creators an you would need to say so in the ReadMe.txt file.

Also regarding your ReadMe.txt file;  It it needs to be corrected.  In
the ReadMe file it says, "ll meshes created in this pack are made by this
PoserPorter User who needs to edit his template/ReadMe.txt file."  We know
this i not true.  You also should identify yourself in the ReadMe and
provide contact information.  include your username and your email
address.  If you would prefer to not list your email address, you can say
something like "If you need to contact me, send me, Galipe, a private
message at Posetteforever."

Also, you can not say, "you can do everything you want with it (Karine)"  
You are giving to the people downloading the zip file full permission do
do anything and everything they want with this zip and its contents.  
This you can not do, because you can not grant to people more rights or
privileges than you yourself have with the contents of the zip file.

Let me give you an example of how this works.  I have made a few packages
containing rendered landscape images to be used as backgrounds for people
to use in their personal works; however, I do not give them permission to
use these backgrounds in any commercial work of any kind.  That is not my
choice for I do not have the right to offer that permission.  The software
that I use to render most of the landscapes is a free version of terragen.  
The free version permits me to render images and use them or to share
them for free but the owner of the software does not give permission for
the software or the picture made with to to be used commercially.

When you have made these corrections, please email the corrected version
to me at and when it is in proper condition, I will put
the new version in the Posetteforever freestuff in the place of the
version that has been removed.

Once again we, the staff of Posetteforever, thank you for offering to
share Karine.  We are looking forward to your sharing a corrected
version of your lovely Posette character and having her made available to
to all the artist who are members of Posetteforever.

We have had no answer or other reaction from Galipe.  I think we have waited long enough.  Today, I deleted Karine from the free stuff and deleted the announcement topic also.

Soon after having deleted Karine from the free stuff.  Galipe returned and contacted me, then he emailed me an updated copy of Karine.  The updated copy looked clean, so told him to go ahead and upload.  He did.  Now, I am a day late posting about it.

The file seems "clean" now, but there´s still the reference to Posettes obj in the readme´s file listing. I think, this should be no problem as long as the obj itself is not contained...

About Karine, I was concerned about the problems files, and I forgot about the Readme.  It would be better if it were not written that way, but I am thinking that it is harmless.  To ask Galipe to change it again, may not be a good idea at the moment.
